You may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos): www.aepd.es, Spain's supervisory authority for data protection.

1. Who is the controller of your data?
THE CLEVERGY SOLUTION, S.L. is the controller of your personal data for the purposes of providing you with the services identified in this privacy policy. THE CLEVERGY SOLUTION, S.L. is a company with its registered office at Calle Goya, 62 - PISO 8 C, 28001, Madrid, Spain, and its tax ID (CIF/NIF) is B09897489 (hereinafter, the "Client").
2. What information do we process?
To use this application and the services it offers, we will request data such as your name and surname, contact details, national ID number, postcode or your energy supply point number, all of which are necessary in order to handle your request and/or provide you with our services. All fields marked with an asterisk (*) in the forms provided to you through our channels are mandatory, so omitting any of them may make it impossible to provide the services requested.
So that the information provided is always up to date and free of errors, you must notify the Client as soon as possible of any changes to your personal data. Likewise, by clicking the "I accept" button (or equivalent) included in those forms, you declare that the information and data you have provided in them are accurate and truthful.
3. Where does the data come from?
We consider all data processed by the Client to have been provided to us freely by you. Should the personal data provided belong to a third party, you warrant that you have informed them of this Privacy Policy and obtained their authorisation to provide the data to the Client for the purposes set out above. You likewise warrant that the data provided is accurate and up to date, and you accept responsibility for any direct or indirect damage or loss that may arise as a result of failing to meet that obligation.
4. For what purpose and on what legal basis do we process the data?
The Client acts as controller of personal data, on the basis of managing the contractual relationship, in order to provide you with the services you request from us, enable access to your customer section in the app, and handle your requests for information as well as any issue or request arising from the contractual relationship. On the basis of your consent, we will request access from third parties to information about your consumption in order to provide you with information about it and recommendations on how to reduce it.
5. Who is the data shared with?
We may disclose some of your data to partner companies so that they can identify you when you agree that they may provide us with data about your consumption. Beyond the above, we do not disclose your data to third parties other than the communications necessary to public or judicial authorities in order to comply with the legal obligations applicable to us. However, should any disclosure be necessary, we will inform you in advance and it will always be carried out on a legal basis that legitimises the processing.
Likewise, the Client warrants that where there are suppliers located in countries outside the European Union, or in other countries not deemed adequate under data protection legislation, the necessary precautions are taken to ensure that data can be transferred securely — either because the supplier offers appropriate safeguards, or because one of the safeguards established in data protection legislation has been adopted to ensure that international transfers comply with the law.
6. Exercising your rights.
Please note that you may exercise the following rights:
- The right of access to your personal data, in order to know which data is being processed and what processing operations are carried out on it.
- The right to rectification of any inaccurate personal data.
- The right to erasure of your personal data, where this is possible.
- The right to request restriction of the processing of your personal data where the accuracy, lawfulness or necessity of the processing is in doubt, in which case we may retain the data in order to bring or defend claims.
- The right to object to automated decision-making, including profiling.
- The right to object to the processing of your personal data where the legal basis entitling us to process it, in accordance with section 4 above, is legitimate interest.
- The right to data portability, where the legal basis entitling us to process it among those set out in section 4 above is the existence of a contractual relationship or your consent.
- The right to withdraw the consent given.

We also inform you that you have the right to lodge a complaint with the Spanish Data Protection Agency if you believe we have breached data protection legislation in relation to the processing of your personal data.
In addition, you may register with the Lista Robinson at www.listarobinson.es: the advertising exclusion system managed by the Spanish Digital Economy Association (ADIGITAL), which you can join in order to record your objection to your data being used to send you commercial communications.
8. How long we keep your data.
We will only keep your data for as long as is necessary to provide you with these services. Any data you provide us through our channels will be blocked once it is no longer needed to manage the service, and will only be available where there is a legal obligation (arising from a request by State law enforcement bodies or by courts and tribunals) or when you exercise your rights.
9. Security and confidentiality.
In order to prevent unauthorised access to or unauthorised disclosure of personal data, we have put in place appropriate technical and physical measures, as well as management processes, to safeguard and secure the information we collect from you.
10. Updates to the privacy policy.
We make every effort to keep our privacy policy fully up to date. If we make changes, they will be clearly and specifically identifiable, as far as is possible within the relationship we have established with you (for example, we may notify you of the changes by email).
