Purposes of processing personal data:

Provide the requested services. Respond to requests for information. Manage staff selection processes. Request access to your consumption to offer you recommendations. Send commercial communications from us or from third parties, always through Clevergy.

Retention periods: The data will be retained as long as the contractual relationship is maintained, as long as the deletion is not requested by the interested party, or they must not be deleted because they are necessary for compliance with a legal obligation or for the formulation, exercise and defense of claims.

We inform you that you may exercise, where applicable, the rights of access, rectification or deletion, limitation of processing, opposition, data portability or not to be subject to a decision based solely on automated processing, as well as to withdraw the consent given.

1. Who is responsible for data processing?

THE CLEVERGY SOLUTION, SL is responsible for the processing of your personal data for the purposes of providing you with the services identified in this privacy policy. THE CLEVERGY SOLUTION, SL is a company domiciled at Calle Goya, 62 - PISO 8 C, 28001, Madrid., and its CIF/NIF is B09897489 (hereinafter, "Client")

2. What information do we process?

In order to use this application and the services it offers, we will request data such as your name and surname, contact details, ID, postal code or your energy supply number, which are necessary to be able to process your request and/or provide you with our services. All fields marked with an asterisk (\*) in the forms provided to you in the channels must be completed, so that the omission of any of them could result in the impossibility of providing you with the requested services.

In order for the information provided to always be up-to-date and not contain errors, you must notify Client any changes to your personal data as soon as possible. Furthermore, by clicking on the "I accept" button (or equivalent) included in the aforementioned forms, you declare that the information and data you have provided in them are accurate and truthful.

3. What is the origin of the data?

We consider that all data processed by Client you have freely provided them to us. In the event that the personal data provided is from a third party, you guarantee that you have informed them of this Privacy Policy and have obtained their authorization to provide the data to Client for the purposes indicated above. You also guarantee that the data provided are accurate and up to date, and you are responsible for any damage or harm, direct or indirect, that may occur as a result of failure to comply with this obligation.

4. For what purpose and on what legitimate basis do we process the data?

Client acts as the controller of personal data, based on the management of the contractual relationship, to provide you with the services you require, allow access to your customer section in the app and respond to your requests for information, as well as any type of incident or request arising from the contractual relationship. Based on your consent, we will request third parties to access your consumption information in order to be able to offer you information about it and recommendations on how to reduce it.

5. To whom is the data communicated?

We may transfer some of your data to collaborating companies so that they can identify you when you agree that they provide us with data about your consumption. In addition to the above, we do not transfer your data to third parties beyond the necessary communications to public or judicial administrations for compliance with the legal obligations that apply to us. However, if it were necessary to carry out any transfer, we will inform you in advance and it will always be carried out under a legal basis that legitimizes the processing.

Similarly, Client guarantees that if there are suppliers located in countries outside the European Union or others not considered adequate in accordance with data protection regulations, the necessary precautions are taken to ensure that the data can be transferred safely, either because the supplier offers adequate guarantees, or because one of the guarantees established in the data protection regulations has been adopted to ensure that international transfers comply with the law.

6. Exercise of your rights.

We inform you that you may exercise the following rights:

  1. Right to access your personal data to know which are being processed and the processing operations carried out with them.
  2. Right to rectification of any inaccurate personal data.
  3. Right to delete your personal data, where possible.
  4. Right to request the limitation of the processing of your personal data when the accuracy, legality or necessity of the processing of the data is doubtful, in which case, we may retain the data for the exercise or defense of claims.
  5. Right to object to automated decision-making, including profiling.
  6. Right to object to the processing of your personal data when the legal basis that enables us to process it, in accordance with section 4 above, is legitimate interest.
  7. Right to the portability of your data, when the legal basis that enables us to process them as indicated in section 4 above is the existence of a contractual relationship or your consent.

We also inform you that you have the right to file a complaint with the Spanish Data Protection Agency if you consider that we have committed an infringement of data protection legislation regarding the processing of your personal data.

In addition, we inform you that you can sign up for the Robinson List at www.listarobinson.es: the advertising exclusion system managed by the Spanish Association of Digital Economy (ADIGITAL), in which you can register in order to show your opposition to your data being used for the purpose of sending you commercial communications.

8. Period of retention of your data.

We will only keep your data for as long as necessary to offer you these services. Any data you provide us through the channels will be blocked as long as it is no longer necessary to manage the service and will only be available in the event of a legal obligation (derived from a request from the State Security Forces and Corps or Courts and Tribunals) as well as when you exercise your rights.

9. Security and confidentiality.

In order to prevent unauthorized access or disclosure of personal data, we have taken appropriate technical and physical measures as well as management processes to safeguard and secure the information we collect from you.

10. Privacy Policy Update.

We make every effort to keep our privacy policy up to date. If we make changes, these will be clearly and specifically identifiable, as possible in the relationship we have established with you (for example, we can communicate the changes to you by email).
